1. Acceptance of Terms

By accessing or using Encribe (“the Platform”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use the Platform.

2. Keystroke Biometric Data

Encribe collects keystroke timing and dynamics data (“Keystroke Biometric Data”) as a core feature of the Platform. This data is used to:

• Verify that text content is authored by a human and not generated by artificial intelligence or automated systems
• Detect and flag pasted, copied, or machine-generated content
• Provide authenticity verification badges and indicators to readers
• Authenticate your identity — keystroke biometrics is the primary login method on Encribe

By using the Platform, you grant Encribe permission to collect, process, and store your Keystroke Biometric Data for the purposes described above. This consent is required to use the Platform. If you do not consent to the collection of Keystroke Biometric Data, you must discontinue use of the Platform.

Keystroke Biometric Data is processed in accordance with our commitment to data minimization. We do not use this data to personally identify you, sell it to third parties, or use it for advertising purposes. For full details on how we handle your data, see our Privacy Policy.

3. Intellectual Property — Your Content

You retain full ownership and intellectual property rights to all books, manuscripts, text, and creative works (“Your Content”) that you create, upload, or publish on the Platform.

By publishing content on Encribe, you grant Encribe a non-exclusive, worldwide, royalty-free license to:

• Display and distribute Your Content to readers and viewers on the Platform
• Use excerpts, titles, cover images, and descriptions of Your Content for marketing, promotional, and advertising purposes related to Encribe
• Feature Your Content in curated lists, recommendations, newsletters, and social media channels operated by Encribe

This license does not transfer ownership. You may remove Your Content from the Platform at any time, at which point Encribe will cease using it for marketing within a reasonable timeframe, except for materials already in distribution.

4. Live Streaming

When you write on Encribe with live streaming enabled, your writing process — including keystrokes, edits, and revisions — may be visible to readers in real-time. You acknowledge that live-streamed content is publicly viewable and that viewers may take screenshots or record their viewing experience.

You must not stream or publish content that:

• Contains, promotes, or solicits child sexual abuse material (CSAM) or the exploitation of minors in any form
• Infringes on copyrighted material owned by others, including reproducing, distributing, or creating derivative works of protected content without authorization
• Promotes terrorism, violent extremism, or incites violence against any individual or group
• Contains hate speech, harassment, threats, or content designed to intimidate or harm others based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Constitutes fraud, impersonation, or deliberate misinformation intended to deceive or cause harm
• Contains sexually explicit or pornographic material
• Promotes self-harm, suicide, or dangerous activities
• Violates any applicable local, national, or international law

Encribe reserves the right to immediately remove content and suspend or permanently ban accounts that violate these guidelines, without prior notice. Violations may be reported to relevant law enforcement authorities where required by law.

5. Preorders and Backing Authors

Encribe enables readers to preorder (“back”) books that are still being written. Preorders provide funding and feedback to authors during the writing process and are governed by the following terms:

• Preorders are non-refundable through Encribe. Once a preorder is placed, payment is forwarded to the author and is not refundable by the Platform.
• Refund requests, where applicable, are handled directly by the author. If you wish to request a refund or to dispute a delivery, you must contact the author directly. Encribe does not mediate, arbitrate, or guarantee refunds for preorders.
• Authors are expected to fulfill backed works, or to communicate delays and changes in good faith, but Encribe makes no legal guarantee that any backed project will be completed, delivered on the originally announced timeline, or delivered in the form initially described. Creative work is inherently uncertain; authors retain full discretion over the scope, schedule, and final form of their work.
• By placing a preorder, you acknowledge and accept the risk that any backed project may be significantly delayed, change in scope, or fail to be delivered at all. You are backing the author’s effort, not purchasing a guaranteed product.

This model is similar to crowdfunding platforms where Encribe provides the infrastructure for authors and readers to connect, but is not a party to the agreement between author and backer and assumes no liability for non-delivery, delays, or changes to backed works.

6. Account Responsibilities

You are responsible for maintaining the security of your account and for all activities that occur under your account. This includes setting up two-factor authentication (2FA) when available. Encribe strongly recommends enabling 2FA to protect your account.

Encribe shall not be held responsible for unauthorized access, data loss, or any damages resulting from your failure to adequately secure your account, including but not limited to failure to enable two-factor authentication.

You must not use the Platform to publish content that is unlawful, defamatory, infringing, or harmful.

7. Prohibited Uses

• Attempting to circumvent the keystroke biometric verification system
• Using automated tools, bots, or AI systems to generate content and pass it off as human-written
• Impersonating another author or misrepresenting the origin of content
• Interfering with or disrupting the Platform’s services or infrastructure

8. Termination

Encribe reserves the right to suspend or terminate your account at any time for violations of these Terms. Upon termination, your license to use the Platform ceases, but your intellectual property rights to Your Content remain intact.

9. Disclaimer of Warranties

The Platform is provided “as is” without warranties of any kind, whether express or implied. Encribe does not guarantee uninterrupted service, data accuracy, or that the keystroke verification system will be error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Encribe shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

11. Changes to Terms

Encribe may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will notify users of material changes via email or a prominent notice on the Platform.
